Condition Surveys

The procurement of new or pre-used premises brings with it risks as to the condition of the buildings and their suitability for the intended end use. This applies not only to pre-used buildings but also to new buildings where snagging defects and latent defects could cause problems during the lease term.

Typically our surveys entail detailed examinations of the structures, including the roof, and the provision of mechanical and electrical services for which we would manage the involvement of specialist consultants.

This same exercise extends to Due Diligence surveys for clients acquiring new businesses or new premises.

Due Diligence Surveys

For a client acquiring an existing company or group there is often the need to also accept responsibility for existing leasehold properties.

Under these circumstances surveys are carried out to provide an indication of the likely liability attaching to these properties, not only from a structural and defects point of view but also advice in respect of future maintenance and dilapidations costs towards the end of the lease. Where appropriate this can also reuslt in a price adjustment on the commercial transaction as well.

Dilapidations

Trilogie offer advice in respect of dilapidations issues in connection with a client’s property to enable funds to be built up to cover liability for disrepair at the end of a lease, or to agree and mitigate a claim by Landlords.

Similarly, freehold clients are able to build up sinking funds in their accounts to cater for likely ongoing repair maintenance and replacement costs for their premises and any plant and equipment associated therewith.

Our dilapidations expertise also extends to the production of dilapidations claims to be served on sub-tenants or tenants on behalf of a client who has an overriding interest in a particular property as well as the defence of dilapidations claims served on clients and occupiers of premises.

Schedules of Condition

For clients wishing to enter into a lease on pre-used buildings we offer a service to provide Schedules of Condition together with full photographic evidence which can be used to limit the tenant’s liability at the end of the lease.
